These Terms of Service ("Terms") govern access to and use of masscosh.org and any related online services operated by Massachusetts Coalition for Occupational Safety and Health ("MassCOSH," "we," "our," or "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, you should not use the Site.
1. Permitted Use
• You may use the Site only for lawful purposes and in accordance with these Terms.
• You may not attempt to gain unauthorized access to the Site, interfere with its security, transmit malicious code, impersonate another party, or use the Site in any way that could damage or disable it.
2. Intellectual Property
Unless otherwise stated, the Site and its contents, including text, graphics, reports, documents, logos, design elements, videos, and photographs, are owned by or licensed to MassCOSH and are protected by applicable intellectual property laws.
You may view, print, and share Site materials for personal, educational, advocacy, or other noncommercial use provided that attribution and proprietary notices are preserved.
Commercial reuse, republication, modification, sale, or creation of derivative works from Site content requires prior written permission from MassCOSH.
3. User Submissions
If you submit information through the Site, including contact forms, event registrations, comments, applications, or testimonials, you represent that the information is accurate to the best of your knowledge, that you have the right to provide it, and that it does not violate any law or the rights of another person.
By submitting content, you grant MassCOSH a non-exclusive, royalty-free license to use, store, reproduce, and process that content as reasonably necessary to respond to you, operate programs, or fulfill the purposes for which it was submitted, subject to the Privacy Policy.
4. Donations, Registrations, and Transactions
The Site may permit donations, event registrations, training signups, or related transactions. Users agree to provide current, complete, and accurate information in connection with these activities.
Donations are generally voluntary and non-refundable unless otherwise stated at the time of donation or required by law. MassCOSH may use third-party providers to process transactions and registration services.

The Site may contain links to third-party websites, tools, or embedded services. These are provided for convenience only. MassCOSH does not control and is not responsible for third-party content, privacy practices, availability, or services.
6. Informational Use Only
Information on the Site related to workplace health, safety, labor rights, advocacy, public policy, community resources, or training is provided for general educational and informational purposes only. It does not constitute legal, medical, or professional advice.
7. Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MassCOSH disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.
8. Limitation of Liability
To the fullest extent permitted by law, MassCOSH shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to use of, or inability to use, the Site. Where liability cannot be fully disclaimed, MassCOSH's total liability shall be limited to the amount paid, if any, for the specific transaction giving rise to the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless MassCOSH and its officers, directors, employees, volunteers, contractors, and agents from and against claims, liabilities, damages, losses, and expenses arising out of your misuse of the Site or violation of these Terms.

MassCOSH may change, suspend, or discontinue any part of the Site at any time. MassCOSH may also revise these Terms from time to time. Updated Terms will be posted on the Site with a revised date, and continued use of the Site after changes are posted constitutes acceptance.

These Terms are governed by the laws of the Commonwealth of Massachusetts, except where federal law applies.
